General

This Web site is owned by Jumeirah LLC trading as Jumeirah (under license from Jumeirah Beach Resort LLC), limited liability company incorporated in Dubai, commercial registration number 57869 share capital Dhs 300,000 fully paid up, of P.O. Box 73137, Dubai, United Arab Emirates and having its head office at Level 8, Emirates Towers Office, Sheikh Zayed Road, Dubai. For the purposes of these Terms and Conditions "We", "Our" and "Us" refer to Jumeirah LLC. Please carefully review these Terms and Conditions before using this Web Site. Your use of this Web Site indicates your irrevocable agreement to be bound by these Terms and Conditions (as may be amended by Us from time to time).


Data Protection

Any personal information you supply to Us when you use this Web Site will be used in accordance with our Privacy Policy.


Proprietary Rights

All information, documents, and other materials provided on our Web Site (as well as the organization and layout of this Web Site) together with the underlying software code are owned either directly by Us or by Our licensors. We may also modify these Terms and Conditions at any time, and such modification shall be effective immediately upon posting of the modified Terms and Conditions on this Web Site. Accordingly, your continued access or use of this Web Site is deemed to be your irrevocable acceptance of the modified Terms and Conditions.


Limitation of Liability

You agree that you do not (and will not) have any right to bring an action (of any nature) against any of Us or any company or entity managed or operated by Us, or Our or their affiliated, associated or subsidiary companies or the officers, directors, managers, shareholders or staff thereof (together the "Jumeirah Entities") with respect to or in connection with the use of this Web Site. Further, in no event will , any of the Jumeirah Entities be liable for any indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with the access to, or the use of this Web Site or any information contained in it, including loss of profit and the like whether or not in the contemplation of the parties and whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages.

We and the Jumeirah Entities, specifically disclaim all implied warranties of title, merchantability, fitness for a particular purpose and noninfringement, to the maximum extent to which such disclaimers are held to be valid.

You agree to indemnify and keep Us indemnified from and against all costs, claims, demands, liabilities, expenses, damages or losses (including without limitation consequential losses, loss of profit and loss of reputation, and all interest, penalties and legal and other professional costs and expenses) arising out of or in connection with your breach of these Terms and Conditions.

We are not responsible for the information, products, or services obtained on such other sites and will not be liable for any damages arising as a result of or in connection with your visits to such sites. Any links to other sites are provided merely for the convenience of the users of this Web Site and the inclusion of these links does not imply an endorsement of the linked sites or the content therein. In addition, you agree not to link your Web Site or any other third party Web Site to Our site without Our express prior written consent. Governing Law

Your use of this Web Site and the operation of these Terms and Conditions shall be governed by and construed in accordance with the laws and regulations of and applicable in the Emirate of Dubai.


Dispute Resolution

In the event that there is any dispute or difference between the parties arising out of or in connection with the use of the Web Site or these Terms and Conditions, either party may give written notice to the other specifying in detail the subject matter thereof. If the parties fail to amicably settle the same within thirty (30) days thereafter, the dispute or difference shall be submitted to arbitration in the Emirate of Dubai before a single arbitrator. Within thirty (30) days after the aforesaid thirty (30) day period the parties shall jointly appoint the arbitrator but if by the end of that second thirty (30) day period, they have not been able to agree on any such joint appointment, the arbitrator shall be appointed by the President of the Dubai Chamber of Commerce. The arbitration shall be conducted in the English language and in accordance with such procedures as the arbitrator agrees provided that no such procedure shall be contrary to any laws for the time being in force or applicable in the Emirate of Dubai. The cost of arbitration shall form an issue between the parties and be borne as provided in the arbitration award and any award shall be final and binding upon the parties and shall be enforceable in any jurisdiction subject to the laws of the relevant jurisdiction concerning enforcement.

Waiver

Our failure to enforce the strict performance of any provision of these Terms and Conditions or the documents it incorporates by reference will not constitute a waiver of Our right to subsequently enforce such provision or any other provisions of these Terms and Conditions or the documents it incorporates by reference.


Severability

If any provision (or part thereof) of these terms or conditions shall be deemed unlawful, void, or for any reason unenforceable then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

Complete Agreement

These Terms and Conditions and the documents incorporated by reference thereto constitute all the terms of your agreement with Us relating to your use of this Web Site. Save as otherwise provided in these Terms and Conditions and the documents incorporated by reference thereto, you acknowledge that you shall have no remedy in respect of any statement, representation, warranty or understanding (whether negligently or innocently made) by any of Our staff, directors, agents, consultants or representatives (and whether authorised or not for this purpose)

General Programme Rules

1. Definitions in these terms and conditions:

* Jumeirah is an internationally renowned organisation. Its hotels are regarded as amongst the most luxurious and innovative in the world and have won numerous travel awards.

* r&R refers to the Rewards and Recognition Corporate Programme
operated by Jumeirah.

* Member refers to the Company or individual enrolled in the r&R Programme.

* Partner refers to any third party organisation providing Awards or
benefits to the r&R Programme.

* Card means the Membership Card issued by Jumeirah to a Company under its r&R Programme.

* r&R Points are the Award currency earned by using the Card.

* Retroactive claims are the claims submitted by a Member for missing transaction details.

* Redemption is a form of payment using r&R Points as a tender to acquire goods and services within Jumeirah and its Partners.


2. The Card is issued by, and remains the property of, Jumeirah.


3. Jumeirah reserves the right to decline to issue or withdraw Membership at any time, or to terminate the validity of the Card together with the benefits attached thereto at any time. The Card must be returned without delay to Jumeirah when requested. Cancellation of Membership may result in the loss of all accumulated r&R Points, and the Company will no longer be entitled to participate in the Programme.


4. The r&R Programme has no pre-determined termination date and may continue until such time as Jumeirah decides to terminate the Programme, at any time. The Member will have six months from the date of Programme termination to redeem accumulated r&R Points. After this time, a Member may no longer earn r&R Points or claim Awards.


5. Jumeirah reserves the right to amend, update or change any aspect pertaining to the r&R Programme at any time in whole or in part without prior notice.


6. Jumeirah is not responsible for Partner withdrawals from the Programme, or Partner Award cancellations caused by withdrawals or discontinuances of Partner services, which may affect the awards offered.


7. Jumeirah is not responsible for requests or correspondence lost or delayed via post or electronic mail. Jumeirah is not responsible for, and reserves the right to correct, any pricing or typographical errors, errors of description, or errors regarding Participating hotels and Partners.


8. The sale or barter by the Member of any r&R Points, Award Certificates or other r&R benefits is prohibited.


9. Any correspondence sent to Members is based on the information given to Jumeirah. Each Member is responsible for notifying their Sales Manager in writing of any changes in Membership details or update profile on the website.


10. If Members telephone their Sales Manager, for security reasons Jumeirah may ask date of birth and/or other information to verify Member identity.


11. It is possible for Members to edit their profiles online. Alternatively, they can send any changes to the Sales Manager or address to Jumeirah. These changes must be sent in writing on a company letterhead, signed by the authorised signatory.


12. In the event of a Membership Card being lost, stolen or damaged, the Member must inform their Sales Manager within 24 hours.


13. Members may terminate Membership by giving Jumeirah notice in writing, which must be on company letterhead and signed by the authorised signatory. The Membership will terminate immediately upon receipt by Jumeirah of such notice.

Membership Eligibility

14. Participation in the Programme is by the invitation of Jumeirah only. Only an authorised representative of the Jumeirah can enrol a Company.

15. Only individuals assigned by the Company can hold Membership in the Programme. At the time of joining, the Company must nominate the employed individuals they wish to become Members and advise Jumeirah of such in writing.


16. Membership can only be made available to authorised staff within a Company after the Company has been successfully enrolled in the Programme.


17. Membership has an indefinite validity term but will be reviewed every two years from date of enrolment. Membership that is inactive within the 24 month review period will expire, and the r&R Points remaining will be forfeited.

18. Membership will also expire in the event that a Company chooses to no longer participate in the Programme, or if a Member leaves the employment of a participating Company, r&R Points will remain the property of their Company and will be non-transferable.

19. All information requested in the r&R Membership application must be supplied. Jumeirah may reject any application if required information is not supplied accurately and in full.

Earning r&R Points

20. r&R Points may be earned from the day of completed enrolment into the r&R Programme.


21. To ensure r&R Points are earned for qualifying spend, Members must quote their r&R Membership Number when making a reservation or booking an event. If the Membership Number is not given when a booking is made, r&R Points may not be credited to the r&R Account. r&R Membership Numbers will only be accepted at the time of reservation.


22. r&R Points can be earned on rooms, food and beverage transactions charged to a room stay and conference and banqueting transactions as specified by Jumeirah.

r&R Points will be awarded on all eligible room rates. Eligible corporate room rates are those defined as 'publicly available' via Travel Consultants, Jumeirah's website and the hotel directly. Non-eligible rates are defined as airline crew rates, travel industry employee rates, individual wholesale/tour operator packages, groups and rates of Jumeirah employees. Barter, complimentary and Award stays do not qualify for r&R Points. All rooms must be reserved under the Company's name. Jumeirah reserves the right to introduce additional items as qualifying spend.


23. Members should allow up to seven days from the payment of
monies due, for r&R Points to reach the Members' Accounts.


24.r&R Points will not be earned on food and beverage transactions not charged to the room, service charges, tax paid, VAT, telephone calls, miscellaneous items, visit visas and paid out charges. Jumeirah reserves the right to introduce additional exclusions at any time and without notice.


25. r&R Points are earned on the net amount after any discount has been applied to the invoice.


26. r&R Points are valid for 24 months from the date of transaction. Expired r&R Points will be cancelled automatically.


27. An online statement of r&R Points will be communicated to the assigned Member only, on a regular basis (during the validity period of the Card).


28. Jumeirah will only provide information and changes in the Programme to Members who are active Companies.


29. Jumeirah reserves the right to correct any r&R Points values or statements communicated in error.


30. If a Member wishes to claim any adjustment to the number of r&R Points credited, the Member must do so within six months from the date of transaction and by sending written details of the claim to their Sales Manager, together with the copy of the bill for which correct number of r&R Points has not been credited. Members can also claim for missing r&R Points online. Failure to supply the adequate documentation may result in the denial of retroactive credits.


31. r&R Points may not be combined or transferred with any other loyalty scheme operated by Jumeirah or any other airline.

32. r&R Points can only be used by employees of the Member Company.

Redeeming r&R Points for r&R Awards

33. r&R Points can be exchanged for a variety of r&R Awards as specified in the Awards Table.


34. To claim an Award, Members must either contact their Sales Manager or use email, or the Internet. All Awards must be requested two weeks in advance of the date of utilisation of the Award. The Member must make a reservation in advance before they can use their Awards as payment for a room stay or dining, and must state that the reservation is on a Redemption basis.


35. Once a reservation is booked on a confirmed rate it cannot be changed to an Award.


36. Retail items and third party vouchers taken as an Award take up to 28 days for processing and delivery.


37. Jumeirah reserves the right to decline any Redemption if the correct timescales and procedures are not followed.


38. Awards are not redeemable for cash.


39. Awards may not be combined or used in conjunction with any other promotions or special offers.


40. All Red Letter Days Experiences are subject to their terms and conditions.


41. Jumeirah reserves the right to withdraw, amend or add to any Awards and/or offer alternative Awards at any time or impose any requirements or restrictions relating to the use of such Awards.


42. Jumeirah will not be held responsible for replacing lost, stolen, or damaged r&R Awards vouchers. Unused r&R Awards vouchers may not be returned for r&R Point re-credit.


43. In order to qualify for an Award, the Company must have sufficient r&R Points accumulated in the Account to redeem the Award as specified by Jumeirah.


44. Awards must be used within six months from date of issue. If not used within six months, redeemed r&R Points will be forfeited.


45. Jumeirah reserves the right to impose or change the time limit upon the validity for Redemption of any r&R Points, which have been allocated by Jumeirah. This limit may be amended by Jumeirah from time to time, entirely at Jumeirah's own discretion.
